1. Platform Scope & Software-as-a-Service (SaaS) Nature
TOLGA.SI (“Platform”, “we”, “our”, or “us”, developed and operated by Tolga) operates as a Business-to-Business (B2B) Software-as-a-Service (SaaS) platform for automated data visualization and executive video reporting. Our software ingests business-provided operational metrics, spreadsheets (CSV, XLSX), corporate presentation briefs, and internal key performance indicators (KPIs) to compile structured motion graphic video briefings for internal business reporting and client dispatch.
TOLGA.SI is a software product, not a human consulting agency. The software operates strictly through deterministic motion design pipelines pre-calibrated to client brand guidelines.
2. Software Pipeline Setup & Verification Workflow
To ensure data integrity, brand fidelity, and adherence to our technical standards, new customer workspaces undergo a structured software pipeline setup workflow:
- One-Time Software Setup Fee ($250): Covers workspace configuration, data schema mapping, custom motion graphic layout styling, narration audio setup, and technical onboarding support.
- Automated Prototype Rendering: The software engine compiles an initial 9:16 sample teaser master from the client's initial sample data.
- Client Teaser Certification: Automated recurring batch dispatches are unlocked once the authorized client representative inspects and approves the sample prototype directly inside the application console.
3. Strictly Prohibited Uses & Deepfake Ban
TOLGA.SI enforces a zero-tolerance policy against deceptive, infringing, or harmful media. Users and client organizations are strictly prohibited from submitting, generating, or distributing:
- Deepfakes & Unauthorized Synthetic Likenesses: Any generation or simulation of real human beings, public figures, celebrities, or corporate officials without verifiable, written, biometric-release consent.
- Copyright Infringement: Any logos, media assets, trademarks, or copyrighted materials for which the client organization does not possess explicit intellectual property ownership or commercial licensing rights.
- Misleading, Fraudulent, or Deceptive Financial Claims: Generating falsified corporate audits, deceptive investment materials, or manipulative financial telemetry.
- Hate Speech, Harassment, or Explicit Materials: Any content promoting hate speech, violence, adult themes, or illegal activity.
Violation of this policy results in immediate and permanent account termination, forfeiture of unused pipeline credits, and immediate referral to relevant legal authorities where warranted.
4. Payment Processing & Processor Hold Harmless
Payments, subscriptions, credit packages, and setup fees on TOLGA.SI are facilitated through authorized third-party merchant platforms and payment processors, including Polar.sh and associated banking rails.
By utilizing the Platform, the client agrees that payment processors (including Polar.sh, payment gateways, acquiring banks, and card networks) act solely as financial intermediaries and have no control over, nor liability for, the specific numerical data, spreadsheet content, or business directives provided by the client.
The client agrees to defend, indemnify, and hold harmless TOLGA.SI, its officers, engineers, and its payment processing partners against any third-party claims, liabilities, damages, or costs resulting from the client's breach of these Terms, infringement of third-party IP, or violation of acceptable use policies.
5. Credits, Billing & Refund Policy
All fees and credit packages are billed in United States Dollars (USD). Due to the personalized, human-supervised nature of our engineering pipeline calibration, the $250 Pipeline Setup Fee is non-refundable once technical onboarding or schema review has commenced.
Render credits acquired in volume bundles (50, 100, 250 reels) do not expire while the client account remains in good standing. In the event of technical failure to render a certified report resulting from an error within our rendering engine, credits consumed by that job are automatically refunded back to the client's liquid credit balance.
6. Sovereign Data Privacy & Zero Public Model Training
We treat corporate business intelligence with strict confidentiality. All client spreadsheets, financial KPIs, customer metrics, and generated video dispatches remain strictly isolated in client-specific, encrypted sovereign storage vaults.
Under no circumstances are client datasets, confidential briefs, or rendered media ever used to train, fine-tune, or benchmark public machine learning models or shared with unauthorized third parties.
